Sale of Goods Terms & Conditions
Definitions
Buyer or Customer means the person buying the Goods from the Seller.
Goods means the articles that the Buyer agrees to purchase from the Seller.
Consumer shall have the meaning detailed in Section12 of the Unfair Contract Terms Act 1977.
Retail Price means the price of the Goods maintained by the Seller as amended from time to time.
Seller means Lookers Sports Sunglasses.
Terms & Conditions means the conditions and terms of sale laid out in this document and any specific terms agreed in writing by the Seller.
General
These Terms and Conditions shall apply to all orders for the sale of Goods by the Seller to the Buyer, and shall prevail over any other documentation or communication from the Buyer.
All orders for Goods shall be deemed to be an offer by the Buyer to purchase the Goods pursuant to these Terms and Conditions, and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.
Acceptance of delivery of the Goods shall be deemed to be conclusive evidence of the Buyers'''' acceptance of these Conditions.
Any variation of these Terms and Conditions shall be inapplicable unless agreed in writing by the Seller.
Nothing in these Conditions shall affect the statutory rights of the Buyer as a Consumer.
Price and Payment
The price stipulated is inclusive of VAT unless otherwise specified, and is the current retail price on this website at the date of order or as agreed between the Seller and Buyer.
Payment of the total price including delivery charges must be made in full prior to despatch of the Goods.
Delivery
Delivery of the Goods shall be made by the Seller using Royal Mail postal services in accordance with the Terms laid down in the Delivery in the UK and Europe section.
Risk and Title of the Goods shall pass to the Buyer upon delivery of the Goods.
Warranty
The Seller warrants that the Goods will at the time of delivery correspond to the description given on the website by the Seller.
Guarantee
In addition to the Buyers''''statutory rights, the Seller guarantees all Goods against faulty workmanship.
Limitation of Liability
The Seller shall not be liable for any direct loss or damage suffered by the Buyer, however caused, as a result of any negligence, breach of contract, misrepresentation, or otherwise in excess of the price of the Goods.
The Seller shall not be liable to the Buyer or any third party for any indirect or consequential loss of profit, consequential or other economic loss suffered by the Buyer however caused, or as a result of any negligence, breach of contract, misrepresentation, or otherwise.
Force Majeure
Neither party shall be liable for any delay or failure to perfrom any of its obligations if the delay or failure results from circumstances outside its control, including but not limited to Acts of God, strikes, lock outs, accidents, fire, flood, breakdown of plant or machinery, war, or shortage or unavailability of raw materials , and the party shall be entitled to a reasonable extension of its obligations.
Severance
If any provision or term of these Terms & Conditions is held invalid. illegal or unenforceable for any reason by any court of competent jurisdiction, then such provision shall be deleted, and the remainder of the provisions shall continue in force.
Refunds & Returns
You have the right to return an item within 14 days if its damaged or even if you don't like it.
The item must be returned them in original condition in the original wrapping and the same or similar packaging so they don't get damaged in transit
Items damaged or in a used appearance will not be refunded.
Returns are at your own expense, but we will retrun the orginal postage if you paid for standard postage. Next day or upgraded postage from standard will not be refunded in full. The amount refunded for postage in this case will be the differnce between standard and upgraded postage.
